I don’t have the hearts here. How dare they even talk about Court Martial such a patriot & so dedicated. And what a wonderful husband & I should know caring for my disabled husband for 25 yrs & moved him to Fl, ugh for his health. We sailed 14 yrs since 1986 at the Castle Marina run by Mango man. I thought he was vile then but power has turned him into Bonito Mussolini

my supplemental health insurance premium has gone up over 11 % a year several times and the premium has nearly doubled in a very short time. Interestingly, the CEO of United Health Care earned 26 million dollars this year. What is the relationship between my monthly premium and his compensation?

There is law on whether or not a sitting member of Congress can also be on active duty in the military: https://constitution.congress.gov/browse/essay/artI-S6-C2-3/ALDE_00013138/. It is not entirely settled, but since the Nation's founding it has certainly been a rule that sitting members of Congress cannot be on active military duty --- which of course Sen. Kelly would have to be if the Sec. of War-on-Trump's-enemies were to try to all him before a Court Martial. (And of course in the subsequent movie the respective roles of Sen. Kelly's attorney and Sec. Hegseth would be played respectively by the ageless Tom Cruise and whomever the producers could find to play the Jack Nicholson role). And of course, before Sen. Kelly were actually to have his Navy Captain's Commission reactivated, before the Army Captain (for the initiated a lower equivalent rank), the case would go to Court on whether or not it would be lawful for him to be recalled to the Navy. And by the time that one came to a conclusion, with appeals, and etc., hopefully there would be a new Administration in town. So, dream on, Mr. Sec.-of-Trump, dream on. The law permits (and there are several examples of both parties in the 119th Congress) sitting members to serve in the National Guard or Reserve, unless they are recalled to active duty for more than 270 consecutive days. So as long as Kelly’s activation didn’t last longer than that, I assume they could recall him for trial purposes. This wouldn’t be EXACTLY on point, since Kelly is retired, but when you retire, you are transferred to the “retired reserve”, so I assume the same rules apply.

The OTHER wrinkle in this is that if a member is called to active duty for more than 270 consecutive days, they must resign their seat. Hopefully there is some black letter law that says if you’re recalled, you have to be DOING something, because it’s not hard to imagine Sparkle Pony dragging things out to trigger that provision. If he’s actually smart enough to think of it. And he doesn’t read the Endless Urgency comments section.

Thanks for the correction. Obviously, lawyers on both sides will be working hard on this very legally complicated situation. I wouldn’t say “correction” exactly, since you couldn’t be , say, regular army and also serve in Congress. But there is a narrow exception. Which is odd in a way, since USUALLY you can’t be fired or forced to resign because your reserve or Guard unit is activated. Which brings up another interesting point I didn’t think of before — Kelly isn’t in a reserve UNIT, and even if he were, we are not currently engaged in an action that would require mobilization of the reserves.

My hope is that the JAG officers that are appointed to the court martial were among those officers summoned to Quantico to listen to the Sparkle Pony Horseshit Hour. Because those officers did not look impressed.

Thank you, Mike and Amanda. I completely agree that this is one of their most incompetent actions, and while it is disturbing their innocent targets for now I'm sure it will backfire. Unfortunately when things don't go well for Trump he reacts with revenge and retribution.

I am enjoying the conversation and appreciate the messaging about continuing to resist with reference to successes. I also know that the focus is not on international affairs here, but I do wonder if the damage to our global presence and impact can be easily healed, not to mention the setbacks to existing programs across the world that were suddenly defunded during the early months. Healthcare and Education are also areas where the damage will be lasting on many fronts. I agree that we should never give up, but I would be interested to know if you have some uplifting news on the future of USAID (or its next incarnation), the CDC, NHI, and public education. And I do not expect you to do all of the work here, and I will keep on reading and researching on my own. Thanks for the useful insights.

Again, we ask ourselves, "how, in god's name, does this continue? Where is the big outrage and outcry? How are working people not exploding with protest?

And, yes, wind turbines are hazardous to birds. A birder with solar panels, I want to be embracing wind power with enthusiasm, but there's serious work to be done to make them safe.

There’s a 24-year veteran retired Army Ranger Major running for the US House here in NC that’s also getting death threats for backing up Kelly and Company, that were credible enough that even THIS FBI felt the need to notify him. I kind pity the fool that decides to come after him.
